Termination
of Parental Rights/Failure to Rehabilitate
The appellate court affirmed the trial court's decision
to terminate the parental rights of the respondent mother. The court
found the record contained ample evidence of the young mother's
continued struggle with serious mental illness, including paranoid
schizophrenia. Specifically, the mother's intermittent compliance
with treatment and medication management supported the court's finding
that she could not meet the needs of her young child. The court
also properly relied on the recommendations of the court appointed
evaluator who had documented the mother's significant mental health
challenges and outlined specific goals that the mother would have
had to reach in order to present capacity for reunification.
