TRANSFER OF GUARDIANSHIP/INTERSTATE COMPACT Interpretation
of the Interstate Compact on the Placement of Children is the central
issue in this transfer of guardianship appeal. Here, the appellate
court reversed the trial court's order granting guardianship to
the maternal great-grandmother pending and notwithstanding receipt
of the interstate compact study. The appellate court held that the
trial court was not permitted to substitute its own "best interests"
findings in lieu of the interstate compact study. Pursuant to Article
III of the Interstate Compact, the trial court is bound to wait
for and consider the contents of the study and the state is obligated
to notify the receiving state of the impending move of the minor
child.
