Defendant
had been convicted of statutory rape. On the date of the incident,
the victim, born on August 16, 1980, was fourteen years old. The
defendant, born on May 9, 1978, was sixteen. The Supreme Court found
that, at the time of the incident, the defendant was 'more than
two years older' than the victim even though the defendant was not
more than two calendar years older than the victim. Thus, the any
sexual relations with the victim constituted statutory rape under
Connecticut General Statutes § 53a-71(a)(1). The court also rejected
the defendant's argument that, due to the absence of judicial decisions
construing the phrase 'two years older,' the law is void for vagueness.
