The Connecticut
Appellate Court rejected Defendant’s argument that by refusing to
grant a continuance, the trial court effectively deprived him of
his right to legal representation. The Appellate Court held that
because the attorney filed an appearance knowing that he did not
have trial counsel available - since he had to be at another trial
and his law partner had a family obligation - the trial court’s
refusal to grant a continuance was not error. The Appellate Court
maintained that the attorney was 'seeking to transform [a] failed
gamble into abuse of discretion by the trial court'.
